Terms of Service

1. Provider and scope
The Audit Room is a service of BUERGY GmbH, Recheraulaz 10, 3280 Meyriez, Switzerland (UID CHE-218.374.725, VAT no. CHE-218.374.725 MWST), hereinafter «we». These terms apply to every audit ordered through auditroom.ch or otherwise agreed with us. Deviating terms of the client apply only if we accept them in writing.
2. Our service
We provide an independent second opinion on the material you submit, in the format you order (Essential, Deep-Dive or Executive Audit) and as described on auditroom.ch at the time of your order. Audits are delivered in English, German or French.
An audit is a subjective professional opinion based on the material and information available at the time of review. It is not legal, financial, tax, regulatory, investment or certified compliance advice. You remain solely responsible for any decision you make before, during or after an audit. We do not guarantee any particular result or outcome.
AI tools may support research or synthesis. The review, the observations and the judgement are made by a person.
3. Order and contract
The contract is concluded when your payment is confirmed. You receive an order confirmation with a reference number by email. Executive Audits may be preceded by a short alignment on scope before work starts.
4. Prices and payment
Prices are in Swiss francs (CHF) and include Swiss VAT. Payment is made in advance through our payment provider Stripe. We do not store card details.
5. Delivery
Delivery times are counted on business days, Monday to Friday, excluding public holidays in the Canton of Fribourg. Time on weekends and public holidays is not counted. The delivery time starts once payment is confirmed and all material needed for the review is available to us. We deliver the audit to the email address you provided.
If your material is incomplete, unclear or inaccessible, we contact you before starting. The delivery time then starts once the issue is resolved.
6. Your obligations
- You are entitled to share the material you submit, and its review does not infringe third-party rights.
- The material is not unlawful, discriminatory, deceptive or otherwise inappropriate.
- You do not submit passwords, private keys or other credentials, and you only submit personal data of third parties where this is lawful and necessary for the review.
7. Declining an order
We may decline an order within one business day of payment, in particular if the material falls outside our expertise or breaches section 6. In that case we refund the full amount paid.
8. No cancellation, late delivery
Orders are binding once paid. Cancellation by the client is not possible.
If we fail to deliver within the stated delivery time for reasons within our control, you may withdraw from the contract and receive a full refund, or accept a later delivery.
9. Confidentiality
Every order is covered by the mutual Non-Disclosure and Confidentiality Agreement you accept when ordering. It continues to apply after the engagement ends.
10. Rights and use of your material
All rights to the material you submit remain with you. We use it exclusively to carry out the audit you ordered. We do not use it for any other purpose — not as a reference, case study or portfolio piece, and not to train AI models.
You may use the audit freely within your organisation and pass it on to your advisers. Publishing the audit or quoting it publicly with reference to The Audit Room requires our consent. We retain all rights to our general methods, know-how and templates.
11. Liability
To the extent permitted by law, our liability is limited to the fee paid for the audit concerned. We are not liable for indirect or consequential damages, lost profit or decisions you make on the basis of an audit. Liability for intent and gross negligence remains unaffected.
12. Data protection
We process personal data in accordance with our Privacy Policy.
13. Language
These terms are available in several languages. The English version is binding. In case of discrepancies between language versions, the English version prevails.
14. Final provisions
We may amend these terms for future orders. The version valid at the time of your order applies. If any provision is invalid, the remaining provisions remain in force.
These terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is the registered office of BUERGY GmbH. Mandatory places of jurisdiction remain reserved.
